Sorry to hear your story dude. You just met a jerk of a law enforcement official - they are in the minority. Most CBP officers are better than this. Several years ago i too met a jerk like this in an airport in the southeast. I was entering on H1-B, he kept saying that my employer (a reputed american company) was disloyal etc... as he was processing our paperwork. First he grilled my wife, then he started with me, i just responded to him with a disgusted facial expression.. answered his questions rather curtly when asked, did not respond to his rants. His rants were not framed as a question - so i don't have to answer it. All this lasted a total of 5 to 6 minutes as he was checking and stamping our passports.
BTW, not seeing your family for several years is a "humanitarian" cause. Technically the AP is supposed to be used as a travel permit for difficult situations, but most good Americans know that not seeing family for years is a good enough reason. There are jerks everywhere and type A's, thankfully they are not in the majority.

Buddy, your tone sounds hostile and as I said we're staying here by choice - but let me tell you this, after getting an MBA (with financial aid) from a decent school here, staying here for a decade, getting into upper management of a large company and having US born kids, I'm relocating to India after the summer. I've just secured admission for my first born from here and it went without a single glitch.
So, YES, I've tried it, I'm pretty darn willing to and I got a strong pair of balls!

I guess the polling on PD basis is futile it will give people false hope....
Only folks with ND prior to current processing times can expect to have a chance at appoval...I see many people over here beyond the processing date window and are still hoping to get approved....
Let's see if this theory is right or not come september.....if only my lawyer had mentioned that ND over rides PD I'd have forced him to file on July 2nd and not wait till July end....

Your point of ND vs. RD (vs. PD even) is certainly valid, esp. given the randomness of dates that the USCIS follows. However, three things to keep in mind are -
1. Last Aug and Sept ('08), neither ND nor RD theories worked, if you believed all the dates entered under .com. Approvals were quite random - some cases with ND beyond published dates were approved, which led us to believe they were processing in order of RD, but no FIFO was followed based on RD.
2. The dates published recently (09/15/2007 at NSC and 08/30/2007 at TSC) are as of June 30, 2009. It has been nearly two months since and an update is possible. Also, by admission of the USCIS, these dates are not exact, only estimates of what cases are being worked on.
3. Finally, these dates do not serve as guidance for IO to approve cases; they serve as an indication to us applicants as to which cases have been processed thus far. And they help determine if we can file an SR.

Take a look at option from Colorado State Univ Distance Education website. They have a MS(course option), where you need 10 courses to obtain a MS. Each course approx. costs around $1600. So, you are looking at a total of ~17k.
They will also waive GRE requirements if you give evidence of your experience in the industry which looks like is not a problem.
The degree certificate they give you is no different from the certificate one would obtain if one was to attend school full-time and complete the same MS course plan.
Some courses could be completed in summer as well. So, if you can take 4+2+4 over one year during spring-summer-fall semester you could be done in 1 year. I am assuming you don't care about grades, and hence taking 4 courses should be manageable to just get a pass grade.

I am currently filed in EB3 category, and new company I am changing job to are ready to refile my GC. But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.
My son will be in the highschool in 4 years, and I don't want to spend a lot of money on getting MS to myself. But for the GC I am looking for fastest and cheapest way to get MS program. I have no idea how it works, what qualifies me for a degree, what can I get credits for. Any inputs would be appreciated.

if you have wired 10k to NRE account, you can get back 10k back and you can easily get clearance from RBI for the amount that you had deposited.
If you need to bring more than what you had transferred then again RBI has set a cap of about 100k per year per person.

401k and 150,000 in brokerage accounts. My net worth is around 800k, most of my money is in this country. If I want to continue my lifestyle, I need my GC, that will secure my right to live in this country. AFter 9 years of tax paying and law abiding life, I think i have a right to live in this country, but with this stupid laws don't know when i will get my GC.

That may be the unofficial version. Officially you can apply even you haven't worked or studied in Canada if you qualify as a skilled worker with a year of experience. You get extra points for having a job offer from a Canadian employer but not having one does not disqualify you automatically. I'm not talking about getting the GC. I'm just talking about the application process. Some kind of processing is needed even to reject an application and I do not think USCIS is capable of handling the increased traffic that switching to a point based system would result in.

Most people has very misconception about "parole". It is not a free/flexible travel document like visa. As a AOS applicant, one should not leave US till it is approved/denied. One MUST present in US during AOS. The parole is only for any emergency purpose; which is similar to prisioners. As USCIS is flexible, in approving the AP, the people don't realize the travel limitation of AP. They are travelling on AP for vatation/fun etc.. As per law, the AP is not intended for it. The CBP officer was right in asking the legitimacy of the travel. The AP document clearly says it is based on "humanitation" admission to retrun after an emergency travel.
That's correct, but what is one suppose to do when it takes years to get a green card. As someone mentioned earlier, the reality does not match the intent for the law.

Everytime I send a fax to the Senator regarding the Green Card, i get a reply about how they do or do not support H1Bs.
In this whole flower sending campaign, we want the message to be LOUD AND CLEAR. Gandhigiri alone did not drive the British out of India and even if it did, let us not forget in that case the British were on Indian soil, here we are doing Gandhigiri in another country ON THEIR SOIL!!

Keep in mind that 485 eligibility is not just tied to employment but also FBI name checks etc. Do you think USCIS will keep on doing name-checks every other year, or issue EVL's every other year if/when they see for instance, an address change?
On that point (and back to the original purpose of this thread), I called up USCIS to check on the status on my "pre-adjudication". The customer service rep asked me why I had called up when my priority date was not current (!) and I explained that it was because I had only received a fingerprint notice once and that was in Dec 2007; also it was in connection with my EAD application, as I remember it...how can this be if all applications have been preadjudicated. However, I was surprised when the customer service rep informed that my fingerprints had been updated in Mar 2009 and were valid till Mar 2010! When I mentioned that I had not gone in for any fingerprinting since Dec 2007, she even questioned whether I was saying that those were not my fingerprints and someone else had posed as me!! After that I didn't feel like disputing her anymore! She also told me that my application had been "preadjudicated". Has anyone else seen this happen??

Hello To the IV Core Committee,
Thanks to you all for the tireless efforts in pushing the immigration reforms forward .
I just wanted to take this opportunity to give my thoughts on this important Bill HR 5882 that is due for hearing on the 23 Sept'2008 after several postponmetns / adjournments.
I guess that we are fortunate that our Honbl Prime Minister Manmohan Singh is visiting the USA during this week and is scheduled to meet the President George Bush to discuss various issues related to US - Indai Relationships / businessess etc.
I feel that if the IV Core committe makes use of this golden opportunity to meet up with our PM and request him to also discuss on the pending immgt bill that would help several of us.
I'm not sure how best this advise of mine sounds,but i think there is nothing wrong in trying out.
Hope the IV core committe consider this view of mine.
Thanks again to one and all and in particular to the IV folks.
