Apologies if I should have looked this up somewhere within IV .
Guess it is a simple question.
What does a soft LUD mean ? I have often read that term on the forum.
I at times see that something was updated on my case..."last updated date" but then there is no status update.....for example this happened on my I131 application on Feb 4, 2009
On the I485 I think it is just that they transferred it from one office to another as the status says.

Why do the senators not do somthing of this sort .Everything seems to come from the House . If the House is so concerned about the helping EB folks . They must act now and first veto the increase in fees for H1B visas and secondly propose amendments to the Nursoing Amendment to help EB applicants .

I am involved myself in a mess regardning the Green Card labor process
1) I had appplied for RIR labor in Apr 2004 and it was sitting in the Backlog elimination center (BEC)
2) In November 2006 I filed a conversion case and reapplied in PERM on my own while retaining priority date of april 2004.
3) Just last week I got a denial letter from DOL stating the reason
"The employer has not indicated on the application that applicants with any suitable combination training or experience are acceptable. the ETA form 9089 indicates the alien is currently employed by petioning employer and only qualifies for position identified in the application by virtue of the employers alternative experience requirement"
also the letter said
The job requirements did not exactly match the earlier case and hence priority date cannot be maintained
This denial also caused the automatic withdrawal of my earlier backlog case.
4) The priority date was very impt to me since I applied in EB3 and from India.
Is there anything I can do to maintain my priority date. I am also ready to forego the PERM application completely if only I could reinstate the earlier BEC labor case and just wait it out. I understand I commited a blunder by taking the risk of re filing in PERM while maintaining priority date...I feel i am losing almost 3 yrs of wait time and will be relegated to the back of the queue if I refile again

I worked under H1B (valid 11/02/2009 - 10/14/2012) with nonstop paystubs since 11/02/2009.
On 08/02/2010, some bad girl just wrote one short sentence false statement to USCIS and cancelled/revoked my H1B on 08/09/2010 secretly since she didn't notify anybody about what she had done. She also ignored 2 USCIS letters (dated 08/13/2010 and 02/04/2011 respectively) regarding the H1B cancellation.
When I was going to join a new employer in March, I was told that my H1B was "inactive" and "retracted" by USCIS. the bad girl subsiquently filed a H1B petition with nunc pro tunc requirement for me but USCIS only approved I-797B with validation period 04/14/2011 - 10/14/2012 without I-94. I have to get H-1B visa from a US consulate.
Will I be subject to 3 years ban?! Technically I have been OOS since 08/09/2010, however, I have been paid without any gap since 08/09/2010. I have nonstop paystubs since 11/02/2009. I am still being paid. The next paystub will be available on next Friday.
Will I be subject to 3 years ban?! Can I apply for a visa back?! Can I file a criminal charge against this bad girl?!
I feel hopeless until found this forum! Thanks for your helps!!!

I have a PD of April 2008 in the EB2-I category, but am exploring the option of switching to EB1 if possible. I am a clinical psychologist, working in a not-for-profit agency. What are my chances? Does it depend more on the case itself or a really good lawyer who can present your case in the best way it can be presented? This is a really stressful situation because my husband's H1-B runs out next summer and we cannot live here on just my income. Any feedback?
I believe the case itself is the major factor. The credentials/publications/patents + solid letters of recomendations etc is the major factor. The attorney can advice you on the types of letters or proofs that are required to substantiate your case but not more. And ofcourse once you have decided that you could potential go for the EB1, I would certainly ask others for attorneys who have had more success in EB1 cases. The "good" attorney will evaluate your total package and asks you for more documents if it is not good enough. Others will take your money and all material you send and just send it over to the CIS.

Hi,
A consultancy firm applied for my H1b Visa this year (2009). USCIS has denied the visa showing the reasons like:
1) My manager (CEO of the company) and the person I will work under (From the client company) is different.
2) They questioned in same line about the place of my work.(office of the firm and the client).
3) They have some points regarding wages of previously employed H1bs of the firm.
There's no point however about my qualification and experience (I have a degree from IIT and work at India branch of one US multinational). The company says that they have a number of approvals this year and the particular decision depends on the officer at USCIS to a large extend. They can re-appeal addressing all the concerns mentioned by USCIS.
How much are the chances are that a denial would be converted to approval. Is the USCIS going to be very strict and judgmental about the re-appeal of the denial?. May be it is hard to tell, by I greatly appreciate any help/suggestion...

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. There is no way I can travel back to US before August 10th. As per what I heard, a newly issued AP cannot be used to reenter the U.S. if it was not valid as of the date of departure form the U.S. IS this correct?

In case of an RFE for I140 premium processing, can the company respond via Fax or
do they need to send the response via Fedex etc;
For all Premium Processing cases, the service center first sends a fax to the number provided in the I-907 premium processing request form before mailing the hard copy of the RFE. So your lawyer/employer might have already received the fax...Check with them...

Hi,
Myself and my wife applied for 485, 765 and 131 on Aug 13th and we got receipt notices on Oct 5th.
But we got only 485 & 131 for my wife and i got 765 and 131.
485 Receipt is missing for me and 765 is missing for my wife.
We haven't got any mail today also i.e. Oct 6th. Any thing similar happened to anyone?
When we will get other receipts. If at all they are missing can we contact USCIS to send them again?

It seems to me, you are on a B1/B2 and are contemplating a marriage to a "485 current" green card benfeciary...and subsequently filing the 485 jointly with your would be other half...
The intention in a B class visa is very weak and its purpose very limited. It is best to not do anything while on the B visa, and relinquish the B status, then either re-enter on a stronger intent visa (H1/H4 or L1) and then file 485 or file the 485 from outside the country.
Any change of status from a B class visa is usually looked upon with a frown by the USCIS...
Even if you are not contemplating a marriage, but are already married for long but just happen to be in the US on a B Class visa, it is best to reliquish your B status, before doing anyting...

My I-140 was filed on Aug 25 (India -Regular) and I haven't received the receipt number yet? Is this normal for paper filing. What is my best option here to expedite the process?

My (desi) company filed my I140, in 2009 after 8-9 months I checked with them about status of my application; and back office guy said, that my I140 is approved but decline to give any reference/application no.
My doubt is that I never got any receipt number after they filed my I140. My question is that Is it normal if candidate does not get any receipt number, perhaps my company's lawyer got on my/or company's behalf, is this assumption reasonable?
