They are not liable to pay from the the day application was sent.
Instead, they are liable from the start date they requested on the petition OR the day you are physically in US whichever is later.
In most cases employers request immediate start dates so that the employee can start working as soon as the petition is sent (portability).

Hi,
DOB was entered incorrect while renewing EAD. EAD got approved but now I want to send it back to correct the mistake I did. So, I guess my question is - When I send my EAD back with the application for Replacement, do I need to pay the fee for EAD again?

I have a valid H4 after receving the EAD now getting paid on 1099 (on an off), I am planning to visit India this year. My question is!
Can I come back on H4 (I have a valid stamp) or do I have to use my AP since I am using my EAD privileges for getting paid?
Will they know at the Point of Entry that I am using my EAD?

Iam on L2 and working on my EAD which is expiring on april 29 th 2011.
I have applied for H1 in the 2010 quota but due to my employers mistake i got a rejection on that.
we are trying to reappeal to USCIS but iam not sure if its going to work.
Suppose i have a project and apply again for 2011 quota , can i still continue working even if my EAD expires.
They say that we actually move to H1 on October , so if i apply before end of April through premium processing and get an approval notice before October can i continue working or start work right away or do i have to wait till October.
Is there a possibility to start working immediately as soon as my H1 gets approved or do we have to wait until October in any case.

I have a question about multiple 485 filings.
My PD was Eb3 May 2002 and I filed my 485 last week. My wife was added to the application as well.
Now my wife's PD is current and her date is EB3 Jan 2006. Can we file her 485again and add me again as her dependent.
Attorney says no but I am not sure if I can believe them. Besides there is a risk of not filing again for her seperately as in the future the dates may retrogress. I would prefer that both of us have independent applications in as well so we can both fall back on each others application if the need arises.
Is any one else in my shoes and knows the answer

According to this document, if you switch jobs it IS better to file the AC21 and inform the USCIS, just in case trhe employer decides to reovke the I-140.

Hi All,
I need to travel urgently to India due to some family issue and my EAD is expiring in Aug 2010. I need to apply for my renewal before I fly out this Sunday since I will have to be in India for 30 days. Can I e file my application from here and send the supporting documentation by Saturday? If so, I want to make sure that if for some reason, I get a biometrics appt., while in India, how can I postpone it? and also there won't be any issues with my EAD renewal app since I will be India and My I 94 will change once I am back.

You said that by AUG 2008 bulletin, your dates are current.. Which date we should refer to? Date from I-140 or date from I-485?

We have applied for COS for my wife from H4 - F1, and yesterday we got approval.
(TOOK ONE MONTH APPROX),
Now the question is,
I AM AWARE THAT SHE HAS TO GET STAMPED IF SHE TRAVELS TO INDIA, BUT what if she travels to India, when on OPT status????
Any seniors had experienced the same situation?????????

My employer has asked me to take care of our office in India. I am on H1B that will expire in 2011. We have decided for me to spend 2 months in India and one month in US. The plan is to reenter US on H1B since it will still be valid.
I also have a pending 485 and i am going to let my EAD and AP timeout and stick to H1B.
Now, the question is: will this be a problem? Is there a limitation on how long an H1B holder stay outside the US while continuing to maintain status?
I am going to be travelling back to India soon but have already spent more than 5 months in india this year (onver three trips) and am wondering if there will be a problem when i come back in november.
I cant find anything on the net no this.
There is no problem. I had to do it for same reason i had to work 2-3 months in 2 instances. And for the final time, it was 15 month offshore India assignment. No problems at all.
