I only meant if you have the native country license already or if you can get it remotely. Leaving the US for the express purpose of getting you native country license would be an overkill...as you would agree :)
Unfortunately, I can't leave the US for the following reasons
a) AOS pending
b) H1 expiring soon
c) Won't get any vacation time as just joined a new job.

Sorry to hear about your experience. I can say that I have traveled on several occasions out of the United States to Canada, Mexico and the UK for business and pleasure using Advance Parole without incident. I don't understand how Customs and Border Protection can expect us to remain in the United States indefinitely and postpone living our lives! I am fully aware of the statute but I don't buy into its literal interpretation. This is just an opinion. Ultimately you must decide individually what you feel comfortable doing.

My understanding was that once the 485 is filed, you go by RD. It doesn't matter what your PD is...

My calls are continuing. Called all the Ds and a few Rs and I will finish calling the remaining Rs in another one hour. And this is my third round of calls.
Rep. Howard Coble's (R-NC) office would not listen to you if you are not from his district. I still insisted that my support for the bill should be noted.

Does your job requires you to have a Master's degree (or B.S. with some experience)? If it does not.....then you dont qualify for EB2. There is more to it. This is just a simple illustration. Even if you are a PhD if you take a job that requires only B.S. then you only qualify for EB3. This is my understanding.

Yes. AC21 has nothing to do with AP directly.
But it enables job easy change into a similar job if you have EAD. And that provision is predominantly used by people going thru the AOS process.
When they use AC21 to change jobs, they are strictly in AOS and not in another visa status.
My point was that when AC21 was made, they did not look at all the down stream impacts.
anyways... lets not argue about AC21<->AP.
Since DOS routinely updates their forms, why can't the the form used for AP be updated to change its wording?
Can this be approached as an administrative fix?
You can use H1-B transfer under AC-21 so you don't loose Non Immigrant visa just because you used AC-21 provisions.

There are no bills being discussed. House as well as senate are on recess and will convine after Sept 10th. After it reconvenes, between 10th sept and Oct 8th - it has a lot of tasks at hand, and no apetite for any big and controversial issues like immigration. Mid term elections are in early nov and nobody wants controversial bills debated just before that. Morover it has been made clear that GOP does not want any immigration bills except "fencing the border". Democrats do not have required votes for cloture.
So, nothing is going to happen on the immigration front- legislatively untill after nov elections. Attitudes towards this issue will change and more GOP Lawmakers wil favor talking about this after. It will be a different ball-game depending on who keeps the majority. In the lame-duck there might be a chance.

Which state are we talking about here?
New DL renewal Procedure is a painful process which started August 1, 2006.
The process involves;
1. Visiting a DMV office and they will ask for your documents and give you a case number which you will present to MVI.
2. MVI will investigate your immigration status with USCIS and you will receive a letter after 5-7 days. If there is a problem, it will take upto 9 weeks. This means, you cannot drive until they have verified your legal status in the US.
This is a new procedure and I know a couple of friends who currently cannot drive because they cannot renew their license.
At first, DMV branches were unaware of this new procedure.
Has anyone been through this new process and successfully pass through MVI and renewed their license or is anyone waiting for the letter from MVI for more than 7 days.

Folks,
For NRE account, you can easily send money to india and then repatriate it back. But in my case I have money to my NRE and bought an apartment. Now since i have sold that apartment, that money is in NRO account which is a one way account. You can only send money to NRO but you cannot get that money back in dollars from it.
Talking about getting money thru travellers check, you can do that only if you go to india and come back here in US with it....since you have to sign it at both places. Also there is a limit of $1500 for TC's when you come from India. Limitations....limitations....limitations.
If we send money to India for investment purposes.....all you will get is LOSS.
I started a business in India....lost lot of money in India becoz ppl in India do not want to trade honestly......bottomline......if you want to stay in US,,,,dont send your money anywhere....use in US and enjoy that money !!!

Assuming that I got my EAD, and then my I-140 got denied for whatever reason.

I think there is a need to educate politicians that the problem is not H1B but GC backlogs. As per USCIS only 7100 H1B's have been utilized so far for FY 2012. Unless they provide clear and time bound path to Permanent Residence, positive economic contributions from high skilled immigrants would be minimal.
Lawmakers will listen to folks who participate in lobby/advocacy activities..apparently H-1B lobby/advocacy is louder than the GC backlog lobby/advocacy and that's what we hear in the news.

a) your AP is valid, OR
b) if your H1-B has a valid visa stamp and you didn't use your AP
ie, basically if you have other valid documents to enter the country back, is the application deemed abandoned?
2. Which "application" is deemed abandoned? Application for obtaining the AP or the I-485?

USCIS procedures suggest that for preadjudicated cases, they assign visas in order of PD, which should be the case now as focus appears to be on preadjudication. However, if there are no preadjudicated cases, as seemingly was the case last year, they have no way to do it in PD sequence. In that case, they pick files case by case in sequence of receive date (not the RD on your receipt, but the date when someone entered case data, which is close to ND) which works better for USCIS (but not for us) with wide open cut off dates.
What makes people think that USCIS has preadjudicated cases in the order of priority date. If they have preadjudicated cases from 2005,2006 and left the cases from 2003 -2004 then it is the same mess an d i can bet that knowing USCIS chance of this are very very high so even if your date gets current it is still luck whether you get GC ornot.

When there is a overflow, I strongly feel that it should flow to all the categories and that is called equality. Some inefficient people in Decision making authority at USCIS framed a rule on visa overflow and they are following it. If the rule is not much logical/ethical to most of the people, then anyone can voice their rights against it.
Just for example, a team consists of one project manager(EB1), two tech leads(EB2) and 6 Developers(EB3). The demand is based on no. of vacancies exists on the market, that means a lot of EB3, less EB2 and few EB1.
As per this rule, USCIS is not actually feeding the hungry.
Regarding the country quota, US is not favoring/helping the foreign countries by giving GC to those people from them. So, it makes no sense at all when it comes to immigrants but I can understand the bureaucracy behind it.
If they are implementing the country limit then it should be like 0.00001% of that country's population, I feel.
What are you talking about? There are a limited number of green cards each year. The US wants the best of the best to get these green cards. Therefore, more preference is given to those with a higher degree or more experience. What's unjust or unfair about that? The trick is to look at things from the American perspective and not from the immigrant perspective.
