    Here is my recent experience,
    in the month of april my wife and I had received RFEs for 325 and birth certificate, we submitted the evidence and there was soft LUDs for almost a week, case status said a decision will be made in 60 days. I t is more than 90 days, so I called up the customer service (I very well know that they can't issue GC as the priority date is not current) I spoke to her as a layman and filed for a service request. Here is the email that I got:

    The AP is truly an amazing conundrum. I will try to clarify.

    1. When AP is filed, you need to be in the US. No if's and but's about that.
    2. If AP is used at the border for entry, it DOES NOT invalidate your H1. Only using EAD to switch jobs does that.
    3. Lets assume you have an AP valid till Jan 1. You apply for new AP on Oct 1. However, you need to travel on Dec 25. Now there are two scenarios:
    3a) you return on Dec 30 - you can use your old AP as it is still valid. The fact that you have applied for a new AP and left the country DOES NOT abandon your new AP because your old AP is still valid.
    3b) You return on Jan 3 - You need to have the new AP in hand.

    Does that mean that wife can travel after applying for the new AP and then i will post her the renewed AP, which she can use to reenter say after the expiry date of the old one so in this case 3rd Jan ? Cause i had asked this question on this forum and i was informed that when she is travelling to India she must get the new AP approved, i cannot send it to her via mail

    No vkkkk, I'm not playing. What some people are saying is logic and what i'm saying is the fact. You seems new in this form. But i think most of the people here are serious and try share their sufferings, free help from freinds (virtual).

    Anyway, My lawyer used the PERM. right after i received my Labor (may 2006) I had to renew my H1b which took 6 months (regular processing). After i received my renewal I sent my I-140 application. I didn't even bother to use the premium processing for my i140 because the i485 was not current that time, instead it way way back as a EB3. anyway, you know the rest of the story.....

    Very well said, nozerd. Indians may keep dreaming about INR gaining value against USD. It might actually happen at some point of time, but without the proper infrastructure that it needs, its going nowhere in my opinion.
    What India needs is

    Transparent Government without any trace of corruption atleast in regular day-to-day life
    Clean drinking water, un-interrupted power supply
    Roads and neighborhoods without trash pile ups
    Change of people's attitude that Govt should do everything for them, but without having to have pay taxes, fee etc.

    Yes but in Canada you will breathe clean air and drink clean water. You will have electricity 24 hrs a day and water 24 hrs a day. You wont find trash on the street and you wont be considered second class citizen if you arent SC/ST/OBC due to reservations. You woint have to give "donations" to get your kid admitted to Class 1. You wont face a system where a simple court case drags to 50 yrs or a case where doctor will not treat if before police does a "Panchnama" if you had an accident. You wont have to bribe everyone from minucipality to police to start a business.

    When you send all the relevant documents to invoke AC21, there is every possibility for the officer to check whether you have an approved EAD or not. In that case there might be a problem. I may not be correct. But to switch to a new employer, you definitely need a EAD card. I switched employers. My new employer asked for work permit(EAD in this case)

    Note : Please check with your attorney, I'm just one like you and this is my experience

    The only thing I agree in post is that check with attorney.

    EAD has nothing to do with invoking AC-21. Please do some research before posting any information. Remember GC is for the future job and not for the current job.

    I have similarly checked a site here in MA which most of the local indian community visits. The prices are little high and I'm negotiating. If sulekha is visited a lot please enquire about the prices and then you can forward to the media committee.

    I'm planning to contribute to the ad myself if the local website agrees to my terms. (Still bargaining !)

    Sukekha.com is the most visited website for INDIANS in NORTHEAST....for all classifields. Would it be very expensive to put up some banners in LEADING indian websites where lot of INDIAN IT people visit.

    The PD current for EB1 in the month of Oct.
    I have filed my I-140,I-485 on Oct10 2007 in the category of EB1.
    But until now i did not receive any confirmation notice..
    Can anyone say what should i do now or have to wait for some more weeks?

    Can somebody clarify what it means that "salary is large enough" for EB2?
    If a PWD was obtained from the state "workforce agency" and it has some number there, the job order has been placed with that number, can DOL and/or CIS later on (while processing PERM and/or I140) still say that the salary is "not good enough for EB2"? Based on which considerations and how are we and the employer supposed to know them beforehand then?

    But look at the case before this bill i.e now
    With 140,000 we have more candidates in the backlog and many more joining through Perm process.
    If CIR is passed, many in the backlog will move to new merit system because their labor is still pending and no new GC application after May 21st 2007 also.
    So, you have lot less people picthcing against 10% of 90,000 visas vs the case now where there are lot more people for 7% of 140K.

    I still don't get why it is bad for everybody?
    It is definitely little better for those who can use older GC process/system with 10% of 90K visa numbers.

    Also, i bet there will be another amendment to add more to 90K for clearing the backlog much faster.
    i see your point now. thanks. i wonder how many ppl do not have 140 approved by now.

    Why is this being discusses here??

    Just a dose of how things are on the other side. This may be more obvious when more companies start outsourcing.

    On the other hand, this thing may not affect non IT folks.

    My 2 cents - be careful at workplaces and try to avoid discussing about our issues with co workers, 99% of them are ALIPAC, NumbersUSA, Programmer's guild etc....

    They are the ones working against you

    Luckysiri, I am sure things will work out for you and your family. You definitely need to expose and name your employer whose sadistic attitude caused so much pain and suffering during these critical months. We need to teach such employers a valuable lesson so that they don't ruin some one else's peace of mind. Good luck.
