Hi Gurus,
I am in a unique situation and your valuable advice is highly appreciated. I worked for company A for 3 years and filed my 140 and 485(july 2007). I quit the company in may this year and joined another company. My 140 was approved on 06/16/2006. recently my previous employer revoked my I-140. I got a notice from USCIS that my I-140 and I-485 has been withdrawn. As per my new attorney since i meet all the conditions for job porting (180 days, 140 approved, and same job profile), no one else other than me can withdraw my I-485 application. my attorney filed an MTR today. Can i work while my MTR is pending. Is Withdrawal acknowledgement notice is same as denial notice ? please help

If you were not told the correct bill rate, you can recover that money. Simply ask them in writing to show you the contract since you are on 70/30 basis. The written contracts, oral contracts, emails all stand in the court but how will you prove an oral contract? If you have found an offer that meets your expectations just quit. We all make the same mistakes. We spend our time on working out things where they are not working. Just "quietly" without your employer getting a hint, find a job and quit.

You are right -- 3 Year Bachelor + 3 year Master (in related field) is good to go. 3 Year Bachelor + 2 year Master is unlikely to sail through.

Senior guys, if you don't like a thread, ignore it, the thread may be of interest to some people on the forum. So let those people talk. Also since nothing is happening on the immigration, what else public will do other than 'Time pass'???
I am assuming that you have gone to school and taken some exams/tests. Did you study during your exams/tests or did you study and prepare before your tests?
After doing all this "very important" discussion about Rs/$ conversion, if you get sometime, please read some news about immigration bill to find out that there is lot of activity going on with the immigration bill. Most of the time anti-immigrats are calling and putting pressure on lawmakers who support any sort of immigration bill. That is why McCain, Brownback and many others backed out. Anti-immigrants are working overytime making it look like as if their opinion is the opinion of the entire nation. Each person is making 20-30 phone calls a week. But it is ok if none of us is doing anything. Lets all "time pass" and have this very important discussion about Rs/$ eachange rate variation... right?
Communities/groups/societies who do not understand the need to organize and standup for themselves always perish. Durbin-Grassley bill is just the beginning of the time for this high skilled immigrant community to disappear. Reason - When any group of people increases in number there is always another group which becomes its natural opponent/adversary. This community of over a million people also have very powerful opponent/adversary. That opponent is gaining strength and working overtime to purge all of us. But that is ok, let us talk about Rs/$ conversion rate. Anybody here from Uruguay or Morocco??? Why don’t people from Uruguay or Morocco and all other countries of the world join us in this VERY VERY important discussion about the recent exchange rate variation of Indian Rs/$. Dear Nixtor, we should not question that when they do not have IV on their site and they do not cut us any checks. It is their site and they can architect it the way they can. Yes, the Indian Express misquoted Robinderi or may be it was a misrepresentation, we would never know but the good thing is that he has acknowledged the discrepancy. That is where it ends. Robinder has been a very highly regarded ananlyst and a commentator of indo-us relationship. We needs friends with him and not make enemies. It is a different thing that he is associated with USINPAC and we do not agree with their agenda, approach or the way they misrepresent themselves to be the representatives of Indo community in USA. We have about 2.5 million Indians in USA of which about more than half a million are stuck in this green card mess. Any organization that claims to be a representative of Indian community should have this Green Card reform as a very top priority in their agenda, but it was extremely disappointing for the people fighting for this cause when they approached some of these organizations who could provide just lip service and press releases from their chambers and project that they are on the top of the issue and working hard to get the work done. IV has filled this void for a true grass roots level organization with a huge membership base which is truely global,not just Indian and working in an extremely organzied fashion. I am sure that many of the the organizations envy the way we have built the membership base ( we are not a paid membership org) and have individuals roll up their sleeves, go to the fields across the country and work for this noble cause unlike others who are limited to doing press releases, photo opportunities and advertizing to promote them selves.
At the end, time will tell if Immigration Voice would be successful in the agenda it has enbarked on, but what ever the final result be, our efforts would be analyzed for years to come by the ethnic, minority and national groups as to how to unleash the power of the Internet to build and run a grass root level oranization. Can you imagine how it would have been if Internet were available at the time of Mahatma Gandhi? I am sure Robinder has been thinking and analyzing that and we would welcome his analysis.

If there was a common goal indeed, why we have not worked together? I just pointed out the feelings some people on this side of aisle share. I threw them out there, while others chose not to. I just looked around and why any one is supporting now and not before. Hey, Never late than now. I, personally am more than willing to know why the American Indian Citizen community has always ignored this heavy weight issue, especially when the drums beat heavily on how to retain the culture.

What state are you living??
I have been thinking for a long time to own a gun but due to my H-1B status could'nt own one. My I-140 was approved last year and now I am working on EAD.
I am wondering if anybody else in a similar situation purchased a gun; I mean after he/she started working using EAD. I tried to research the issue but the law is not clear on the subject.

Can somebody clarify what it means that "salary is large enough" for EB2?
If a PWD was obtained from the state "workforce agency" and it has some number there, the job order has been placed with that number, can DOL and/or CIS later on (while processing PERM and/or I140) still say that the salary is "not good enough for EB2"? Based on which considerations and how are we and the employer supposed to know them beforehand then?

Yesterday, I was told by the client that my project is going to end by this month end i.e Apr 30. Actually it was supposed to go for the next 2 years. I am currently in the project working for the project. They said the lay off was becoz of budget issues. But I see I am the only one that is target in this lay-off. I am working with the same client for the past 3 years. The lay off news was really shocking and devastating.
I am currently 9 months pregnant. As the client did that to me, I thought that atleast I might have some options with my current employer. My employer is a desi consultancy. I never been on Bench for single day for the Past 6 years ( Day 1 that I entered into US to till now).
When I spoke to my employer today he gave me a termination letter stating that my project end date will be my last date with them. It was more shocking. I will be on maternity leave anytime in month of may depending on the delivery. I don't see any possible options that any client can take me into project when I am in 9th month of pregnancy.
As my husband is doing consulting, I filed the green card thru this employer, 485 is pending more than 180 days, 140 approved in EB2 category. We paid all the attorney fees and filing fees from our pocket. We spent nearly $10,000 for the GC process. My husband was on bench for the past 2 months. He got a job on EAD which is going to start next week.
1. I see that my employer is terminating me immediately because he can avoid maternity expenses. I told him that I will take 3 months FMLA for unpaid maternity leave from Apr 30th. And look for the Job immediately after delivery and get into the Job. But still he is telling he won't provide me that time. Maintaining the status is very important for me as me and my husband depends on the EAD.
2.My medical insurance is with my employer, If I get laid off in this critical situation, I won't be having insurance. We can't afford the delivery expenses without insurance.
3. Even though my husband will get insurance with the new company, We are not sure that company will cover the pre-existing pregnancy that is in final stages.
4. And also not sure that the insurance will be under the network of OBG/YN and the hospital I registered for delivery. His job is in different state but he will find out the options once he starts his job next week.
5. Does anyone think that my employer is discriminating the law? He is terminating me immediately becoz I am pregnant.
I am not sure whether he is doing the right thing but the situation I am in is the worst situation I ever expected of. Its lot of stress on me and my baby. We are unable to sleep for hour with all the tensions ahead. My husband's job is dependent on my valid status. If something screw up we both be in very bad situation. I really don't want any one in my situation.
Please help me, if any one know any options where I can maintain my status during the pregnancy and maternity leave, Please tell me.

Rememeber GC is for future employment, as soon as the dust settles..you need to find a job!

The worst is that you DON'T die, but have a terminal illness (e.g. cancer), have no job and then incur substantial medical bills. Remember to cover all areas.

She will be in AOS Pending status after Oct 1st, 2007 due to pending I-485 application. EAD does not provide any status.
What is your status? I assume H1-B. You can file for H1 and H4 extensions.

Just like all Muslims are not from Saudi Arabia. They are in 100's of different countres and citizens of diverse nations from UK and Malaysia to Australia and Germany. Christians could be from Europe, Australia and India or the African continent or China and other parts of Asia. I personally know Hindus that are from Fiji, Trinidad, Singapore, Malaysia, Sweden, UK, Canada and they are not Indian citizens.
Moreover, Diwali is for everybody, Just like X'MAS is. You can be an American and be a Hindu. So There is no question of IV getting targetted as India-centric or Indian issues-specific website.

Maybe we should tell NRA that lot of skilled immigrants will buy guns once they have GCs. That could be the fastest way for us to get some lobbying money. It could work faster then the message on "buying houses".
I have lived in Nevada before. I think in that state and many other western states (where guns laws are more liberal) you have to have passport, I-94 and utility bills proving you have lived in NV for 6 months. That's it. You don't need hunting license to get a gun license.
Here is the biggest irony:
IN order to own a gun, FBI needs only 2 days to check your background.
IN order to get 485 approved, FBI takes months or years to do a background check.
I guess green-card is a more lethal weapon than a handgun.

I revisited this thread today and saw several heartwrenching stories of some of our IV members. One way for IV to help you is through letting your situation be known to others via media. We have a few opportunities and if you are interested please send an email to himanshu at immigrationvoice.org. Do not PM me since my PM box gets filled very often.
It will not only help all of us generate awareness about our plight to american public, lawmakers too will be influenced by the magnitude of problems we face while waiting patiently in line for several years. I feel media is a great tool and we can use it very effectively when we all can get our message across in the world outside of this forum. Once we get IV members ready to volunteer for such interviews and to talk about their plight, IV will try its best to get their voices heard.
It will not only help all of us generate awareness about our plight to american public, lawmakers too will be influenced by the magnitude of problems we face while waiting patiently in line for several years. Lets see how much of this bill actually makes it out. As far as I can see, I am prefectly fine with refiling my application under this new category. The hell with EB based green cards.

If we reapply under this section, we will be competing with the massive illegal-to-AOS guys based on our Receipt date for adjudication.
If we get recapture provision in this bill ( most likely ), that would be our best bet.
