Please note that the Form I140 is no longer valid for porting purpose under section 106� of AC21 if the I140 was revoked due to the fact that you did not meet the minimum requirements for the labor certificate at the time of filing. Due to the fact that beneficiary of the For I140 was found to be �unqualified� at the time of filing you are not eligible for relied under section 106� of AC21.

2 year back my I-140 got rejected due to same reason 3+2 degree. I have 3 years Bsc in Computer science and 2 years Master of Computer Mgmt. They raise the question on 3 year Bachealor dagree. My lawyer send the reply along with degree evaluation and we try to say my 3+2 equal to 4+2 of USA and USCIS didn't buy this argument. after that lawyer told me that no hope in MTR or appeal. So we file again in Eb3.
Now i see based on your reply if have taken this approach in appeal then i might have got approval in appeal.

May be this is not a prediction thread. But the OP and some others are all about VB in another thread or two. While I personally dont have any issue with it, it just frustates me that people dont understand that VB is not going to do any magic for PD's in 2003 or later. C mon Lets be realistic. After doing all the math in so many threads, Does any one expect that the PD will be some where in the ending of 2003. Hell no. Then why is that we have a Dec Bulletin thread way back? Now some one is gonna come start a Jan prediction thread. Useless. I just subscribed to that email list on the visa bulletin. It's possible that the people on the list received the bulletin in advance. There are thousands of people on the list. Sure, your point is very much valid. What I understand from the Freakenomics experiment and EB3I behavior with respect to IV is that only a few folks have the perseverance to go all the way from D to B.
Take 100 folks with C grade and give them the $50 offer for B. May be 80% will reach that goal. (I do not recall the actual results of the experiment).
Take 100 folks with D grade and give them the $50 offer for B. Ideally we should see 80% of folks improving their grade to a C (one level up). But in real life only may be half as much (40%) will actually improve their grades to a C.
At this point and esp from states like TN, IN, MO, AR, KS, KY, MO, OH, WI, AZ, NV, NM, UT, CO, OR, NE ..... I will gladly take the 40%, why, I will be happy with 20%!!!!!!!!!!!

I hope you are wrong about this. I do not see anything on the Approved AP that it should has been used for "humanitarian" purpose. It just mentions that the intention of AP is to allow the AOS applicant to return after temporary travel outside US. Correct me if I'm wrong.
You are absolutly incorrect. Unfortunatly most lawyer or their web sites do not explain the limitation of "parole". Because most of the CBP at POE are flexible; that does not mean that the law is flexible. This is what the instruction for AP in the form.
"Advance parole is an extraordinary measure used sparingly to bring an otherwise inadmissible alien to the United States for a temporary period of time due to a compelling emergency. Advance parole cannot be used to circumvent the normal visa issuing procedures and is not a means to bypass delays in visa issuance."

Ronhia, I appreciate your comments. It needs conviction, dedication and consistent efforts to make such accomplishments. Moreover it also demonstrates the character of a person, who can motivate and inspire other kids in a positive way.. especially in an environment full of negative distractions.
If spelling bee competition is considered merely as just cramming the dictionary, as you rightly said we need to really spend some time looking beyond your own shell.
When you open a magazine, for sure, you tend to come across pages that may not be of interest to you. We skip the page and move on rather whining with words (yucky, stupid, senseless) that are inappropriate.
"Winning a national competition is not so great"... again it depends on what is so great to you !!!..

Pre-adjudication where work continues irrespective of visa # availability (where everything else is done except visa # allocation) happens as per the RD of the I-485.
Now even if gc101's I-485 get's pre-adjudicated sometime next year w/o PD being current his I-485 is not "approved" unless visa # is allocated. Now suppose his PD becomes current after his app. is pre-adj., he has very little time to add the spouse name as there is chance like in June that they may quickly assign the visa # and "approve" the file in days.
So gc101 would be safe if his PD becomes current before his file is pre-adj or get's stuck (!) in something like FBI namecheck after pre-adj. which might allow him time to add his wife's name.
My company lawyer addressed this part. The way it works is that they will work on your file only when your PD is current. So even if you apply now, they most likely wont work on it after July as your PD wont be current. Then when next time (say in Jan 2008) when your PD becomes current, they will pick up all the files for that month and start working on it. It might be that they will work on your file on Jan1st or Jan 31st. You can send your wife AOS the moment your PD becomes current. So you want to make sure that it reaches there before they approve your AOS. In case you are extremely unlucky, then they would start working on your file on 1st day of the month and finish it before end of that day, making it impossible for your wife's application to go through. Thats rare though. So if you can make sure that her app reaches on 1st day of the month in which PD is current, then they should most likely add her to your AOS and work on those together and make your life go forward....its a chance which you will be taking...But again life is a chance
