The fact that this is for "select" stores, makes me wonder if they are using this to get people in the store. People might visit to see if they have the iPads in stock, and end up leaving with other products. And even if they do have the iPad in stock at certain stores, the profits they receive from the others who were unable to find the iPad but still make a purchase will probably exceed their loss.
And I'm not talking about TJ Maxx trying to attract the people that would necessarily visit MacRumors. They are most likely trying to target 35-60 year old moms, grandmas, wives, etc. that don't know much about the iPad and would be interested in the other types of products TJ Maxx sells.

If it does go down, ustream.tv will change the stream to a better server, they've done it in the past for video streams of MWSF08 and the special event they had back in March, both thanks to iPhone Alley.

Currently, Apple's usage rights allow downloadable content to be played on an unlimited number of iPods (http://docs.info.apple.com/article.html?artnum=304277) as well as up to 5 computers, although DVD burning is limited to archiving purposes only (DVD-Video burning is not supported).
There's unlimited, and there's unlimited. An iPod can only handle protected tracks or movies from five iTunes accounts at a time. That, plus the restrictions on who can load the stuff onto the iPod in the first place, make iTS downloads a lot less attractive than DVD rips for someone looking to get a free ride. The studios don't seem to understand that there is already a pretty comfortable environment set up for them.

There's been reports of battery issues to. I haven't tested it myself, but it seems like I'm getting less battery life since 4.3.1, which is what many others have been saying. I don't know how widespread this isssue is, though.
I had about 200% battery degradation with 4.3. 4.3.1 seems to have fixed that.

My biggest issue with this is when I buy the movie, I expect to be able to watch it on whatever I want, i.e. my HDTV, PowerBook, iPod, or, even in the near future, mobile device, as long as I own the device it's being played on.
When movie industries get the idea that limiting the devices you can play the movie on makes people want to buy the movie even less, then I might consider buying movies online. Until then, I'll stick with DVDs...

If I bought a $450 dollar photo I'd definitely sue! But I'd read the description in full of course!
Don't know about much US law, but I can think of a few challenges to this under UK law off the top of my head. Possibly fraud as well, but only thought about it for a minute or two. If this was ebay.co.uk I'm pretty sure the buyer could get his money back.

I saw that article about the M5 concept this morning. The new 5er looks much better than the one just replaced, but I'm still very partial to the E39 5 series. I had a 2003 530i and to this day regret getting rid of it.
BMWs are sort of like Mustangs with me. I'm always sort of indifferent to them when new ones are released, but as years go by and they get older, I start to really like them. The E39 M5 is no different. It is in my Top 10 favorite cars of all time, easily. It rides that fine line between sport and luxury so well....

i, too, am firmly in the "Notes Haters" camp.
I know that I will get the usual canned response here from Notes fans ("but, you see, it is not just an email app, it is so much more...").
Yeah, they're probably the worst fanboys in the IT industry; "But it can do so much!" yes well if it can do so much, why is it the crashtastic pile of shite that it is today? If it crashes on you, you have to reboot the PC, cos just trying to start Lotus Notes again will give you a cryptic error message.
The user interface is the worst ever ("click that little unmarked rectangle top-left in the mail view to check for new mail!", and, oh, about 10'000 other possible examples of UI idiocy).
The last two jobs I've held have forced me to use this decades-past-it's-heyday trainwreck, and even though I've used it in various incarnations (~R4-R6 and whatever the latest public version is), I would love to know what the people at IBM were and still are smoking. Shouldn't you fix glaringly obvious bugs, from release to release? Do they even employ UI designers at IBM? Do they actually consider things such as optimizing performance, when rolling out a new release?
As far as I can see, the sole reason it still exists, apart from the fact that you can send and receive emails and do scheduling with it (which are the two things most companies use it for today), seems to stem from the veritable ARMIES of consultants and developers that keep on recommending it, ostensibly to protect their own incomes after having spent thousands learning how to develop applications for it.
