uscis works in funny ways (as we all know). As I stated in earlier post one case in nebraska i know got rejected and they stated that the appeals decision wasn't precedent. The texas cases received rfe's but got approved based on the decision.
Just yesterday, I received 140 denial from texas where they didn't even discuss the decision and just picked on that bachelors was three year degree.
Same case was with me. They picked on my 3 year bachelor degree. Can i do appeal after 2 years ?

Yes that is assuming they have not lived in this country for the past 10 years. My husband's employer has filed his GC the last day before the 5 year and every year his job changes to restrcture they keep filing his labor again and again and it is such a mess.
It won't be so terrible for those who filed in 2006/07 to wait another 2-3 years. Plus poeple like me (PD sep 2004) will file in the new Point system reducing backlog for others.

You said Labor do says BS+5 year Exp. is OK.
If nothing comes up...Check if your original employer files New I140 to consider you in EB3 instead of EB2 using same labor.
Even for that Nebraska expects a single source degree apart from 16 years of education for bachlores.

My heart really goes out for Neelima and her family! I also faced this kind of situation in my office to a lesser extent.
I am working as a permanent employee for a company and there are very few Asians working in this company. One of the business unit is outsourced to India and in our annual off-site meeting, the manager of that business unit sarcastically mentioned in the meeting infront of all the employees, how people in India lie about their resumes and how Indians are inefficient etc. etc. I felt so angry, sad and immediately walked out of the meeting.

Thanks to the efforts of everyone at IV and QGA, we have the golden opportunity for a member of IV to actually testify before Congress. No kidding!
This has to be one of the best and most effective chance we have to make our point directly to the lawmakers
IV is looking for someone who is in the �limbo� stage, and has made a significant contribution to the economy (ie, invented something, made a medical discovery, created a lot of jobs, etc.)
Please treat this as very very urgent. We need someone like this ASAP.

I don't know if this question has been asked before. Is there a benefit for filing AP by paper rather then electronically. I filed EAD by paper to TCS and got the "Card Production Ordered" email yesterday (in 14 days) for myself and my wife. My friends who efiled just received finger printing appointment notification and no receipts. Is there same benefit with AP? Please calrify.

Does any of you trade in Indian shares? If so, did you have to open the PIS NRE account to do trading in Indian shares ? I heard that NRI from USA can not use the normal demat account to do the trading in secondary market in India.

I have a trading account with IB, which I opened about 3 years ago. But now they need all trading account holders to provide their PAN information. They can not sell or purchase without that. My account is also in a suspended state becaus eof that(Good that I could not sell them,,, they are all about 3 times now :) )
I've applied for PAN and asked IB to provide info on what I need to do to convert my regular account to an NRI account.

You can't generalize. If your kids are smart they can get into better colleges like IITs etc. I think you are confusing the issue about adaptability with good future prospects.
Wait a second. If you are not adaptable to the new environment, it becomes a rat race.If the situation is not conducive, your smartness aint gonna help. I think thats what the OP clearly meant. Its not easy for a kid who is in 8th grade in US to snugly fit into Indian System. Coming to the IIT's, Have you ever compared the total number of seats available in IIT's to the accepted numbers from IVY leagues and other big schools. In India, you have to be the best among the best to get into IIT's. You have to be best here and oh yeah.. You dont have to lose some of the smartness to reservations. But I agree with you that parents should let children pursue their own interests rather than thinking about him/her being a doc/eng.

Guys -
Dont lose "Hope". Its the most audacious word. I left the country in May 2009 with frustration , anger and the fact that whenever I was finding a contract in that tough times peoples were even NOT interviewing me the moment they heard that I'm a "H". They dont want to hear if I have EAD or my GC is going on - PERIOD. The vendors and contacts who loved me ( because they ripped high billing from me in 2000-2009) even started ignoring me.
I felt harassed that i'm fighting on a "non-level" playing field. Eventually I got something at CA (I live at MA) for 55/hour and on the other hand I got a top notch salary offer from a US born Hardware company's Offshore office at Bangalore, India. They SHIPPED all jobs from US to India. I took that offer because I have my Old parents there at India and missed their company for 9+ yrs ( apart from regular vacations).
However I could not adjust with several things there and ran back here after 10 months and found a truly EB2 job and ported my EB3 Mar 2005 Priority Date to EB2 in less than 1 year - I'm CURRENT ( YAAAYY !!) and Waiting for GC to come any day....
By the way - I'm not M.S from US or any kind of masters degree holder from anywhere. I have a strong B.E degree from one of the Top 10 engineering colleges of India (not I.I.T though) and 11+ yrs US experience and 12+ yrs total IT experience in my kitty.
Nothing is impossible - Wish Best of Luck to all EB3 India guys , you have the ability to turn the game , just play it truthfully and play it smart.

You mean to say sell US real estate for GC/citizenship? I don't see this going very far. I can see anti immigrants waiting for this one. Best is to lobby using aides of big corporations, developing relationship with lobbyists who already have connections, hiring lawyers, developing strong case, donations in election campaigns etc. All of this needs loads and loads of money. Are we ready to donate to IV and build strong lobbying group for our cause? That is the only way to change our current situation.
Sending flowers, sending pizzas, sending all these proposals will only fall on deaf ears. Congress understands language of money to pass laws, Rest of the country/orgranizations understand language of laws/court.
For those who think assisting US economy by buy houses (for pending GC applicants) is like selling a GC are just plain dumb! No wonder why we dont have a resolution to the 10 yr waiting that's been killing EB immigrants, is because ppl like you, who love to take pain want others to live through this for the lifetime.
People have been waiting for 10+ years here waiting to get GC, waiting patiently, waiting so patiently that we are getting mentally sick waiting and waiting. How do u think the quota system is ..its not fair in the first place for EB immigrants when we are already here on H/L visas... . We the prospective, EB immigrants want to settle here. Its more than a home here already if you are living and paying taxes for 10+ years.. We just want to buy a house and a permanent visa status is only going to help. Its a win-win situation for both sides....

I would strongly urge IV to take this and would be willing help and have a dialogue with any state/congress representative they want me to.... How do u think it wont' fly. US govt is spending and bailing out trillions of dollars to help cure this cause. If we buy houses, it is only going to help the cause. Most of us have good credit score and can afford to buy houses, this will only help the very thing that the govt. is trying to stabilize.
I'm surprised, how come IV is not aggressively pursuing this. What better way to help everyone here. If they want to address the fundamental issues they certainly can, but this the immediate focus and like quota recapture, will provide immediate relief to decades long wait for applicants!
So pls stop disparaging the effort. Its a good cause for both sides.

If my priority date is retrogressed at the time of processing my EAD and AP, will USCIS keep the EAD and AP on hold? Or will they process EAD and AP and hold the I485?

FYI majority of Desi companies follow the rules as stipulated by US laws. There definitely are abuses in any law. Do you think all wallstreet firms played by rules in this financial mess.

if u know any indian grocery near by they deal money also . u can pay the money to thier people in india & they will give it here taking 1 or 2% commission . but u should know the people , otherwise they will cheat
